What would you do if your kindergartner was kicked in school?

My daughter had been complaining for weeks about a little boy that sits next to her in music cl that's "mean" to her and gives her "dirty looks." I told her if he keeps his hand to himself & isn't hurting her to just ignore his dirty looks and he would quit doing it. Well after more than 3 weeks of her complaining & telling me she was scared of this boy I finally decided to bring it to the teachers attention. That very day, he kicked her in music cl. When I picked her up the teacher apologized and ured me & my daughter that she would move them away from each other in music cl. The next day she told me she had decided not to move anyone, but to just keep an eye on it. Well, my daughter is scared to go back to music cl even more now. Would you talk to the teacher again & insist that she move them away from each other or just let her "keep an eye on it?" What would you honestly do if it was your daughter??
